Terms and conditions governing the use of CargoPack 3D software, desktop applications, and cargopack3d.com services.

Welcome to CargoPack 3D (“we”, “us”, “our”, or “the Software”). These Terms of Service (“Terms”) govern your access to and use of the website https://www.cargopack3d.com (“Site”) and the CargoPack 3D container loading optimization desktop software and related services (collectively, the “Services”).

By downloading, installing, accessing, or purchasing a license for CargoPack 3D, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access the Site or use the Software.

1. Software License & Permitted Use

  • License Grant: Subject to these Terms and your purchase of an applicable license plan, CargoPack 3D grants you a non-exclusive, non-transferable, revocable license to install and execute the Software on compatible Windows workstations solely for your internal business operations.
  • License Types:
    • Free Trial License: Granted for evaluation purposes only for a period of up to 15 calendar days.
    • Professional / Single User License: Valid for single-seat activation per purchased license key.
    • Enterprise License: Governed by agreed seat quotas or floating license parameters.
  • Restrictions: You agree not to:
    • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software or its 3D heuristic algorithms.
    • Sublicense, lease, rent, redistribute, or resell the Software license keys to unauthorized third parties.
    • Use the Software to build or train a competing container optimization software product.

2. Merchant of Record & Payment Processing

Important Notice Regarding Merchant of Record (Paddle):
Our order process and billing are conducted by our online reseller and Merchant of Record, Paddle.com Market Limited (“Paddle”), Judgement Hall, London, United Kingdom, and its affiliated entities.

Paddle is the Merchant of Record for all our orders. Paddle handles all customer service inquiries related to payments, tax calculation, invoicing, and returns/refunds. When you purchase a license for CargoPack 3D, you enter into a binding sales contract directly with Paddle, subject to Paddle’s Terms and Conditions.

3. Intellectual Property Rights

All intellectual property rights, including but not limited to copyrights, patents, proprietary spatial packing heuristic algorithms, 3D rendering engines, trademarks, trade secrets, logos, and documentation related to CargoPack 3D and cargopack3d.com, are and remain the exclusive property of CargoPack 3D and its licensors.

4. Updates & Maintenance

We may, from time to time, issue updates, patches, bug fixes, or new versions of the Software. Minor updates and algorithm improvements are provided free of charge to active license holders. We reserve the right to modify or discontinue features with reasonable advance notice.

5. Disclaimer of Warranties

CargoPack 3D provides container spatial calculation and optimization simulations based on mathematical heuristic modeling. The Software is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.

While CargoPack 3D accounts for standard container dimensions and packing tolerances, the user remains solely responsible for verifying on-site physical cargo safety, container axle weight distribution, SOLAS VGM compliance, vessel seaworthiness, and adherence to local transport weight limits.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall CargoPack 3D, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, cargo damage, port detention fees, freight demurrage, or business interruption) arising out of or related to your use of or inability to use the Software. In any event, our aggregate liability shall not exceed the amount actually paid by you for the Software license during the twelve (12) months preceding the claim.

7. Termination

We reserve the right to suspend or revoke your license key and access to the Services immediately, without prior notice, if you breach any material provision of these Terms. Upon termination, you must cease all use of the Software and uninstall all copies from your computers.

8. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Software following the posting of revised Terms constitutes your acceptance of the changes.
